This terms governs your use of the Fyrasail Site and any site designated by us(the “Fyrasail Site”).PAM Technologies Pte Ltd and/or its affiliates (“PAM”,”we”) provides the Fyrasail Site to you subject to the following terms of use (“Site Terms”). By visiting the Fyrasail Site, you accept the Site Terms. In addition, when you use any current or future PAM services, content or other materials, you also will be subject to the Fyrasail End User License Agreement or other agreement governing your use of our services (the “Agreement”).

COPYRIGHT
All content included on the Fyrasail Site, such as software (including machine images), data, text, audio, video, or images, is the property of PAM or its content suppliers and protected by Singapore and international copyright laws. All software used on the Fyrasail Site is the property of PAM or its software suppliers and protected by Singapore and international copyright laws.

DISCLAIMERS
THE FYRASAIL SITE AND SERVICES ARE PROVIDED ON A “AS IS” OR “AS AVAILABLE” BASIS, UNLESS AS SPECIFIED IN THE AGREEMENT. WE AND OUR AFFILIATES AND LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE REGARDING THE SERVICES, INCLUDING ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT, WILL BE SECURE OR NOT OTHERWISE LOST OR DAMAGED. EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES AND LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR USAGE OF TRADE.

LIMITATIONS OF LIABILITIES
WE OR OUR LICENSORS WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA), EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER, NEITHER WE NOR ANY OF OUR LICENSORS WILL BE RESPONSIBLE FOR ANY COMPENSATION, REIMBURSEMENT, OR DAMAGES ARISING IN CONNECTION WITH: YOUR INABILITY TO USE THE SERVICES, INCLUDING AS A RESULT OF ANY UNANTICIPATED OR UNSCHEDULED DOWNTIME OF ALL OR A PORTION OF THE SERVICES FOR ANY REASON, INCLUDING AS A RESULT OF POWER OUTAGES, SYSTEM FAILURES OR OTHER INTERRUPTIONS AND THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES. YOU EXPRESSLY AGREE THAT THE USE OF THIS SITE IS AT YOUR SOLE RISK.

LICENSE
PAM grants you a limited license to access and make personal use of the Fyrasail Site and not to download (other than page caching) or modify any content and portion of it, except with express written consent of PAM. This license does not include any resale or commercial use of the Fyrasail Site or its contents; any derivative use of the Fyrasail Site or its contents; any downloading or copying of account information; or any use of data mining, robots, or similar data gathering and extraction tools. Unless otherwise specified by PAM in a separate license, your right to use any software, data or other materials that you access or download through the Fyrasail Site is subject to the Site Terms or, if you have a Fyrasail account, the Agreement.

SITE ACCESS
Any content or portion of the Fyrasail Site may not be duplicated, reproduced, license, copied, sold, resold or otherwise exploited for any personal or commercial purpose without express written consent of PAM. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, audio, video or page layout) of PAM without express written consent. You may not use any meta tags or any other “hidden text” utilizing PAM's name or trademarks without the express written consent of PAM. Any unauthorized use terminates the permission or license granted by PAM. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the Fyrasail Site, as long as the link does not portray PAM, or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any PAM logo or other proprietary graphic or trademark as part of the link without express written permission.

MODFICATIONS AND SEVERABILITY
The Site Terms may be modified at any time by posting it on the Fyrasail Site. If any of these conditions are deemed unenforceable, invalid or void, that condition will be deemed severable and will not affect the validity of the remaining conditions.

APPLICABLE LAW AND DISPUTES
This Site Terms shall be governed by the laws of Singapore and any disputes or claim relating in any way to your visit to the Fyrasail Site shall be determined by binding arbitration in Singapore, rather than in court.
